SEQUOIA HEALTHCARE DISTRICT
BOARD OF DIRECTORS
RESOLUTION DECLARING THAT THE DISTRICT'S REAL PROPERTIES
LOCATED AT 2900 WHIPPLE AND 525 VETERANS BOULEVARD, REDWOOD
CITY, CALIFORNIA, ARE SURPLUS AND AUTHORIZING THE SALE OF THE
PROPERTIES
WHEREAS, California Health and Safety Code Section 32121.2 provides that the board of directors of Sequoia Healthcare District may, by resolution, authorize the disposition of any surplus property of the District at fair market value;
WHEREAS, California Government Code Section 54221 defines "surplus land" as "land owned by.. .any local agency [which includes the District], that is determined to be no longer necessary for the agency's use;"
WHEREAS, Title 5, Division 2, Part 1, Chapter 5, Article 8 of the California Government Code (Sections 54220 through 54232) requires that prior to disposing of surplus land, the local agency shall send a written offer to sell or lease the property to various other governmental entities, as set forth in Section 54222, which shall have 60 days to respond and 60 additional days to negotiate, after which time, if no agreement is reached, the District may sell to any other purchaser;
WHEREAS, sale of surplus property of the District is categorically exempt from the California Environmental Quality Act under 14CCR 15312;
WHEREAS, the District ceased owning and operating Sequoia Hospital in 1996
and since that time has considered how it might best dispose of its remaining real property consisting of the medical office buildings located at 2900 Whipple Avenue and at 525 Veterans Boulevard (both of which are currently fully leased for medical purposes);
WHEREAS, the demand for such buildings is currently favorable; and
WHEREAS, the healthcare needs of District residents can better be served by selling these medical office buildings and using the proceeds to further the District's healthcare purposes;
RESOLVED, that the Board of Directors of Sequoia Healthcare District hereby
1. Finds that the medical office buildings owned by the district and located at 2900 Whipple Avenue and 525 Veterans Boulevard in Redwood City, California, are no longer necessary for the district's use.
2. Declares that the above described medical office buildings constitute "surplus property" for purposes of California Health and Safety Code Section 32121.2 and "surplus land" for purposes of Article 8 (Sections 54220 through 54232) of Chapter 5 of Part 1 of Division 2, of Title 5 of the California Government Code.
3. Directs the District staff to carry through the process set forth in Article 8
(Sections 54220 through 54232) of Chapter 5 of Part 1 of Division 2 of Title 5 of the California Government Code (and to make any such sale or lease thereunder at fair market value) and thereafter, if either or both of the medical office buildings are not so disposed of, to sell it or them on the open market at fair market value.
As the duly elected Secretary of Sequoia Healthcare District, I hereby certify that the above accurately reflects the resolution which has been duly adopted and approved by the Board of Directors of Sequoia Healthcare District at its duly noticed and constituted meeting held on the - day of , 2004, by the following vote:
